1. Seller and scope

These General Terms and Conditions of Sale (the “GTC”) govern all sales concluded through the website realrussianhair.com between SERENDAB GmbH, Lettenstrasse 9, 6343 Rotkreuz, Switzerland, registered under UID CHE-329.951.076 and operating under the trade name “Real Russian Hair” (the “Seller”, “we”), and any customer placing an order on the website (the “Customer”, “you”). They are available in French, English and German.

Placing an order implies full acceptance of these GTC in the version in force on the date of the order. Provisions granted specifically to consumers apply only to Customers acting as consumers, that is, for purposes outside their trade, business, craft or profession.

2. Products

The Seller sells natural hair extensions and related accessories. The products are presented with the greatest possible accuracy. As the products are made of natural hair, slight variations in shade may occur between batches and between the photographs and the delivered product, in particular due to screen settings; such minor variations, which do not affect the nature or quality of the product, do not constitute a lack of conformity.

3. Ordering and conclusion of the contract

The order process comprises the following steps: adding products to the cart, entering delivery and payment details, reviewing and correcting the order, and confirming it by clicking the order button, which creates an obligation to pay. The contract is concluded when the Seller sends the order confirmation by e-mail. That confirmation includes a summary of the order.

The Seller may refuse an order on legitimate grounds, in particular where the delivery address is outside the delivery area defined in clause 6, where a previous order remains unpaid, in the event of suspected fraud, or where the quantities ordered indicate a purpose of resale.

4. Prices, VAT and taxes

Prices are displayed in the currency indicated on the website and include any applicable value added tax (VAT). Where VAT is due, the applicable rate and amount are shown at checkout and on the invoice. The price applicable to an order is the price displayed on the day the order is placed. Delivery costs, where applicable, are indicated before the order is confirmed.

For deliveries to Switzerland dispatched from our warehouse in France, Swiss import VAT and customs clearance fees may be collected from the recipient by the carrier, unless otherwise indicated during checkout.

5. Payment

The means of payment accepted are those displayed at checkout. The price is payable in full when the order is placed. Payments are processed by secure payment service providers; the Seller does not store card data. The Seller may withhold dispatch until payment has been authorised.

6. Delivery

We deliver exclusively to Switzerland and to the following countries of the European Union: France, Germany, Austria, Belgium and Luxembourg. Delivery times, costs and conditions, the passing of risk, and our back-order policy are set out on the “Delivery & Returns” page, which forms an integral part of these GTC. If the goods are not delivered within 30 days of the conclusion of the contract, the Customer may request delivery within a reasonable additional period and, failing delivery within that period, terminate the contract and obtain a full refund.

7. Retention of title

The goods remain the property of the Seller until full payment of the price.

8. Right of withdrawal

Consumers resident in the European Union have a right of withdrawal of 14 days from receipt of the goods, without giving any reason, under the conditions set out on the “Delivery & Returns” page, which also contains the model withdrawal form. The right of withdrawal does not apply to hair extensions which have been unsealed after delivery, for reasons of health protection and hygiene (Article 16(e) of Directive 2011/83/EU). Customers resident in Switzerland benefit from a contractual right of return of 14 days under the same conditions.

In the event of withdrawal, all payments received, including standard delivery costs, are refunded within 14 days at the latest, using the same means of payment. No processing or handling fee is charged.

9. Statutory warranty of conformity

Independently of any commercial guarantee, the Customer benefits from the statutory warranty of conformity provided by the law of his or her country of habitual residence, for a period of at least two years from delivery, and, where applicable, from the statutory warranty against hidden defects. Where a lack of conformity exists, the Customer may, under the conditions provided by the applicable law, obtain the repair or replacement of the product or, failing that, an appropriate price reduction or the termination of the contract and a refund. Nothing in these GTC limits those statutory rights.

To make a warranty claim, contact us at contact@realrussianhair.com, indicating the order number and describing the defect. Where the claim is justified, the costs of returning the product are borne by the Seller.

10. Liability

The Seller is liable without limitation for intent and gross negligence, for death or personal injury, and under mandatory product liability law. In all other cases, the Seller’s liability is limited to the foreseeable damage typical of this type of contract. This clause does not exclude or limit any liability which cannot be excluded or limited under the law applicable to the Customer.

11. Intellectual property

All elements of the website realrussianhair.com – in particular texts, photographs, videos, logos and the “Real Russian Hair” brand – are the exclusive property of SERENDAB GmbH or its licensors and are protected by Swiss, European and international intellectual property law. Any reproduction or use without prior written consent is prohibited.

12. Personal data

Personal data are processed in accordance with our Privacy Policy, available on the website.

13. Amendments to the GTC

The Seller may amend these GTC at any time. The version applicable to an order is the version in force on the date the order is placed.

14. Severability

If any provision of these GTC is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Applicable law and jurisdiction

These GTC are governed by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in a Member State of the European Union, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings before the courts of that country; nothing in this clause deprives you of that protection. Subject to mandatory rules on jurisdiction, the courts at the seat of the Seller (Rotkreuz, Canton of Zug, Switzerland) shall have jurisdiction.

16. Complaints and dispute resolution

For any complaint, please contact us first at contact@realrussianhair.com; we endeavour to resolve any dispute amicably. The Seller is not obliged to participate, and does not undertake to participate, in alternative dispute resolution proceedings before a consumer arbitration body, without prejudice to any mandatory provisions applicable in the Customer’s country of residence.
